A proposed settlement has been reached in a class action lawsuit against Asure Software, Inc. (“Defendant”) regarding a timekeeping system sold by Defendant that allegedly disseminated workers’ biometric information through use of an Asure timeclock at Packers Sanitation Service facilities located in Illinois, purportedly in violation of the law.
The case is Vega v. Asure Software, Inc., No. 2022-CH-00651, currently pending in the Circuit Court of Cook County, Illinois. The proposed Settlement is not an admission of wrongdoing by Defendant, and Defendant denies that it violated the law. The Court has not decided who is right or wrong. Rather, to save the time, expense, and uncertainty of litigation, the Parties have agreed to settle the lawsuit.
If the Settlement is approved, each Settlement Class Member who submits a timely Claim Form that is deemed valid will be entitled to an equal payment from the Settlement Fund. The exact amount of each Class Member’s payment is unknown at this time and will depend on the total number of valid Claim Forms submitted. It is estimated that the net per-person payment will be approximately $950.00-$2,800.00. The Settlement Administrator will issue payment to each Class Member who submits a valid Claim Form following Final Approval of the Settlement.
